Rental agreement
Dumpster rental terms
These terms apply to rentals from Overnight Dumpster, operated by Worthy Group LLC d/b/a Overnight Dumpster. By booking, the customer confirms that they are at least 18, have authority to approve the delivery location, have authority to grant the limited service-location permissions in Section 5, and agree to these terms.
1. Booking, pricing and confirmation
The price shown at checkout is based on the dumpster size, rental length, estimated delivery-distance band, included disposal weight and information supplied by the customer. The full quoted rental price is due at booking; there is no separate security deposit unless one is clearly shown before payment. A rental is not confirmed until payment succeeds and a confirmation number is issued.
Delivery and pickup windows are arrival ranges, not guaranteed appointment times. Traffic, disposal-facility delays, weather and earlier jobs can affect arrival. We will communicate material delays using the email or phone number provided at booking.
2. Included weight and excess-weight charges
The included allowance, excess-weight rate and billing increment shown in the booking summary and card authorization are recorded with that reservation and do not change if public pricing is updated later. The current standard policy is:
- The 14-yard dumpster includes 1 ton ( 2,000 pounds).
- The 16-yard dumpster includes 1.5 tons ( 3,000 pounds).
- Excess weight is $200 per ton, calculated in 100-pound increments ($10 for each increment or part of an increment).
Net disposal weight is the dumpster weight reported on the landfill receipt. After disposal, we will provide an itemized email showing the recorded net weight, included allowance, excess weight and charge. Questions or disputes should be sent promptly to hello@overnightdumpster.com.
3. Card authorization for later weight charges
By separately accepting the card authorization at checkout, the customer authorizes Stripe to securely retain the card used for checkout and authorizes Worthy Group LLC d/b/a Overnight Dumpster to attempt exactly one off-session card charge after disposal, solely for the documented excess weight under Section 2. Overnight Dumpster does not receive or store the full card number. A card issuer may require the customer to authenticate that charge.
This authorization does not permit automatic charges for damage, prohibited materials, failed access, permits, extensions or other service fees. Those amounts will be documented and separately invoiced or otherwise approved. If the single authorized weight charge fails or requires authentication, we will not retry it automatically. We may send a secure payment request and pause future service until the balance is resolved.
4. Prohibited and restricted materials
The following may not be placed in a standard rental dumpster:
- Hazardous or liquid waste, including paint, solvents, fuels, motor oil, antifreeze, pesticides, herbicides, chemicals and mercury-containing items.
- Batteries, tires, televisions, computer monitors and other regulated electronic waste.
- Refrigerators, freezers, air conditioners or other refrigerant appliances; propane tanks or other pressurized cylinders.
- Explosives, ammunition, firearms, hot ashes, smoldering material, medical waste, sharps or sewage.
- Vehicles, large machinery, asbestos-containing material, contaminated soil or any material prohibited by law or the receiving facility.
Concrete, brick, dirt, sod, roofing, non-refrigerant appliances, mattresses, stumps and other unusually dense or special-handling materials require written approval before loading and may require a dedicated container or additional disposal fee. When in doubt, contact us before placing the item in the dumpster.
Call us before loading hazardous, regulated or otherwise restricted material. We may be able to arrange a separate lawful collection, special handling through an appropriate facility or licensed provider, or another disposal option for an additional price quoted in advance. No restricted material is approved until we confirm it in writing.
If prohibited material is found before transport, service will stop until the customer removes it. If it is discovered after pickup, we will follow facility and legal requirements and separately invoice documented handling, return or disposal costs. We may report or surrender regulated material when required by law.
5. Loading, access and service-attempt charges
Material must remain below the top rail, be distributed safely and not hang over the sides. The customer must keep the dumpster and access route free of vehicles, locked gates, snow, mud, low branches, wires and other obstructions. Do not move or alter the dumpster.
A driver will not move a container that is overloaded, unbalanced, blocked or unsafe. If a customer-caused condition prevents a scheduled delivery or pickup after dispatch, a $150 failed-service or return-trip charge may be invoiced. Actual documented unloading, special-handling or disposal costs may also apply. The charge is waived when the failure is ours or is caused solely by unsafe weather. Service resumes after the condition is corrected and a new window is confirmed.
If the customer places prohibited material in the dumpster, overfills it, loads it unsafely, blocks access, or otherwise makes lawful and safe removal impossible, we may decline pickup. The customer's material will remain at the original service property, either in the dumpster or at its existing location, until the condition is corrected and a new service window is confirmed.
We may also pause pickup or disposal when an agreed or authorized amount due before that service—including an approved extension, special-material arrangement or documented service charge—is refused, reversed, charged back or cannot be collected. This does not expand the separate card authorization in Section 3; amounts outside that authorization must still be separately agreed or invoiced.
If we need to recover our dumpster after reasonable notice and an opportunity to correct the problem or resolve the amount due, the customer authorizes us, where lawful and reasonably safe, to remove the dumpster and place the customer's contents back at the same original service property from which they came. This is not permission to place material at a different property or in a street or other public right-of-way. We will not use this remedy for hazardous or regulated material, or where unloading would create an unreasonable spill, environmental or safety risk. The customer remains responsible for the contents, lawful storage and cleanup at the service location, together with any separately agreed or documented charges. If the contents have already been lawfully disposed of, we will address a later payment failure or chargeback through invoicing, service suspension and other lawful collection remedies rather than returning material.
6. Placement, driveways and permits
The customer selects the placement location and confirms that it is level, firm, accessible and suitable for the loaded container and truck. The customer must identify septic systems, irrigation, underground utilities, soft asphalt, decorative surfaces and other concealed or fragile conditions before delivery. Our driver may refuse a location that appears unsafe.
Heavy trucks and loaded dumpsters can crack, mark, rut or otherwise damage asphalt, concrete, pavers, landscaping and underground improvements. We will use reasonable care, but are not responsible for damage caused by a customer-selected location, inadequate or pre-existing surface conditions, or unmarked/concealed conditions. Nothing in these terms limits responsibility that cannot lawfully be limited, including damage caused by our gross negligence or willful misconduct.
The customer is responsible for determining whether an HOA, property-owner or government approval is required and for obtaining it before delivery. Placement in a street, sidewalk, alley or other public right-of-way may require a permit and traffic-control plan. Permit and government fees are not included unless expressly shown in the quote. Missing approval may result in rescheduling and a customer-caused failed-service charge after dispatch.
7. Cancellations, refunds and company changes
- Cancel at least 24 hours before the scheduled delivery-window start for a full refund.
- A cancellation less than 24 hours before the delivery-window start, but before truck dispatch, is refundable less a $75 late cancellation fee.
- After dispatch, a customer cancellation or failed delivery may be refunded less a $150 service-attempt charge and any documented third-party cost. No base-rental refund is available after the dumpster has been delivered.
Approved refunds are returned to the original payment method. We will normally initiate the refund within five business days; the card issuer may take additional time to post it. If we cannot supply the reserved dumpster, we will offer an equivalent or larger unit at no added rental charge, another date, or a full refund. We will not substitute equipment or raise the price without agreement.
8. Weather, extensions and pickup changes
We may delay service when snow, ice, wildfire, wind, flooding, road restrictions or site conditions make travel or placement unsafe. A weather delay caused by us does not add rental days or a failed-trip charge. We will offer the earliest practical reschedule; if an undelivered rental cannot be reasonably rescheduled, the customer may cancel for a full refund.
Extensions, early pickups, pickup-window changes and fresh-bin flips are requests until confirmed. Extension pricing and availability must be accepted before the current pickup. Keeping a dumpster past the confirmed pickup without an approved extension may result in the posted additional-day rate and recovery scheduling, but no automatic non-weight charge will be made to the stored card without separate authorization.
9. Taxes and other charges
Oregon currently has no general sales tax, so no Oregon general sales tax is added to standard rentals. Applicable permit charges, government assessments, special-material disposal fees or taxes required for a different jurisdiction may be added only when disclosed or legally required.
10. Communications and general terms
The customer consents to service-related email, telephone and text communications at the contact information supplied. These are transactional messages, not consent to marketing. Oregon law governs these terms. If one provision is unenforceable, the remaining provisions continue to apply. Changes apply prospectively from the posted effective date unless the customer expressly agrees otherwise.
Disposal and permit resources
Material rules are informed by Oregon DEQ landfill restrictions, Deschutes County hazardous-waste guidance and the City of Bend right-of-way permit page. Facility rules can change, so contact us before loading an unusual item.
